Privacy Policy

nimbus Cloud Trading Co Pty Ltd (“nimbus”), an Australian incorporated company, is the owner and operator of nimbus (“Solution”), the nimbus application (“App”) and the nimbus website (“Website”). 

nimbus respects and protects the privacy of our customers and visitors to our website. We comply with privacy obligations and Privacy Principles (“APPs”) in the jurisdictions where we provide our Solution and services. As such, this Privacy Policy outlines our policies and procedure for collecting, using, storing and disclosing personal information as part of our marketing and product delivery (“Service”). 

Users can access nimbus through our applications on their mobile phones, tablet, laptop and desktop computer, or any other consumer electronic device, and through third parties. 

By accessing our Solutions and App, and using our Service, you are consenting to the collection, storage, disclosure of your personal information, and any other uses described in this Privacy Policy.

Personal Information We Collect

We collect and store personal information in a number of ways, primarily to provide and improve our workforce management solution and services to customers under a User License Agreement (“ULA”) with nimbus. 

Most often we collect information directly from customers who license nimbus during client discovery and implementation of the Solution and App. In doing so, we process data provided by our customers about their employees in order to provide the full benefits of our Solution and Service. 

If you are an employee of a business who licenses our Solution, we collect and store personal information from your current employer that you have consented to being collected by nimbus. You are responsible for ensuring that any personal information collected by your employer is accurate, up-to-date and complete. You can update your contact information anytime on the App or by contacting us at: privacy@nimbus.cloud. 

The personal information we may collect from your employer includes your name, email address, date of birth, gender, residential address, religion, qualifications, previous employment details, skills, and days of availability for work. In addition, you can choose to upload a photo to be stored on your employee profile. If you do not provide us with complete information or do not wish to be identified, then we may not be able to provide services to you. 

When you use the App, we record information from your device. Information may include the type of device you are using, its Internet Protocol (“IP”) address, software and geographic coordinates. In addition, files that you upload, download or create within the App are collected and stored. These may include documents held outside of the nimbus App. 

We also collect personal information when you register for a demonstration or contact us via our Website so we can contact and communicate with you about our Solution and Service. Information we collect includes items such as your name, company name, phone number and email address. We may use the contact information to send you marketing materials. Your contact details, if used in Direct Mail or Email campaigns will be securely shared with third party providers of these services if you have agreed to receive communications from nimbus. You can opt-out of these communications at any time.

Aggregated Usage Data

Personal information does not include “Aggregated Usage Data”. Aggregated Usage Data helps us to understand how users interact with our Service, so we can improve on our products, provide better features and customer service. In addition to collecting Aggregated Usage Data, we may share this data with third parties, including partners and service provides, for various purposes, including to help us better understand our customer’s needs, improve our Service, and for advertising and marketing purposes. We do not share Aggregated Usage Data with third parties that would enable them to personally identify you.

Our Sites and Cookies

nimbus may receive non-identifiable information about your use of our Website. We do this through the use of analytics to better understand usage activity and patterns so that we can improve on our products and Service to you. 

nimbus uses “cookies” to collect information and improve our Service. Cookies is a small software file temporarily placed on your device to identify you electronically to us. Cookies enable us to better understand how you use our Service, to save your username and password for future logins to the Solution and App, to identify you when you are logged in, and to monitor traffic. You can instruct your browser to accept or decline cookies at any time. nimbus may use similar technologies for reasons including, but not limited to, storing a user’s preferences and settings, authenticating users and to detect fraudulent use. 

How We Store Personal Information 

The information we collect is stored within the nimbus Solution, App or nimbus servers. Data elements relating to personal information stored in the Solution are defined by the client and can range from basic method of recognition (first name, surname or unique identifier such as payroll or reference number), to additional elements relevant to the client needs and in line with their existing HR policies (as detailed in section 1). 

This data can then only be accessed by approved client end users with assigned unique username and encrypted password. All data is hosted primarily with the Microsoft Azure and Amazon Web Services listed environments which provide high level of security protocols and environmental security. 

Additional data elements may also be stored within nimbus Customer Service Portals for accredited trained staff to ensure appropriate helpdesk support can be provided. This data is updated accordingly and in line with client assignment of security access to accredited client users.

How We Use Personal Information

We will use the personal information collected to provide you with access to the nimbus Solution, nimbus App and to provide you with our Services. Other reasons we may use your personal information is for administration and support purposes, to inform you of software updates, new product and feature announcements, and to evaluate and improve our service to you. We may also use it to compile anonymous statistical demographic information on the use of our system. 

In addition to the purposes described above, we disclose personal information if required for any legal purposes. 

Data Retention –We will retain your personal information for as long as your account is active and for as long as needed to provide our Service to you, subject to our compliance with this Policy. We may retain and use thispersonal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. 

If you are a customer and would like to gain access to, or request deletion of information we have collected, please contact us at: privacy@nimbus.cloud. 

We will endeavour to delete your information promptly upon request, however deleting information from our servers may take more time and backed-up versions might still exist after deletion. We will only delete stored information if a formal request is sent from the data holder. If we receive a request from an individual that is not a business owner, we will direct that request to the business that they belong to for validation before nimbus can action the request. 

Cross Border Disclosure –nimbus is only likely to provide personal information to overseas recipients if potential employers have offices located outside of Australia where information is stored, or have outsourced cloud storage facilities located offshore. nimbus will take such steps as are reasonable in the circumstances to ensure that any information that is disclosed to an overseas recipient does not breach the APPs in relation to the information received.

Our Website may at times contain links to other sites that are not owned and controlled by nimbus. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every website that collects personally identifiable information.

Children

We do not knowingly collect any personal information from children under the age of 13. If you have any reason to believe that a child under the age of 13 has provided information to nimbus, please contact us and we will endeavour to delete that information from our servers.

Security

nimbus is committed to ensuring the security of your personal information. We will take such steps as are necessary in the circumstances to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure, and to destroy or de-identify the personal information if it is no longer lawfully required. nimbus will only disclose your personal information to overseas recipients as stated in this document.

Access to Your Personal Information

You have the right to access your personal information and have any inaccuracies in your information corrected. If you wish to exercise these rights, or wish to make a complaint, please contact us at privacy@nimbus.cloud or contact us to us via our Privacy Officer. nimbus will respond to all requests within a reasonable time and will respond to complaints in accordance with nimbus’ complaints resolution process.

Changes to Our Privacy Policy

nimbus may make changes to its Privacy Policy from time to time. Our current Privacy Policy will be available on our App and Website or on request. If you do not accept the terms of this Policy, you must discontinue use of our products and Service.
